How Building Better Bodies collects, uses and protects your personal information.

1. Who we are

Building Better Bodies is operated by Matt Thomson in Alexandra, Central Otago, New Zealand.
Building Better Bodies provides Personal Training, online coaching and access to the BBB Training App through Everfit.
In this policy, “Building Better Bodies”, “BBB”, “we”, “us” and “our” refer to Building Better Bodies and Matt Thomson.

2. Information we collect

The information we collect depends on how you interact with us and which services you use. It may include:
- your name, email address, telephone number and contact preferences;
- your age or date of birth where relevant to the service;
- your goals, training experience, preferences and availability;
- health, injury, medical, movement and exercise-readiness information;
- information supplied through pre-screening, onboarding, progress check-ins and coaching conversations;
- session bookings, attendance, programme activity and training progress;
- photographs, videos, measurements, results or testimonials where you have agreed to provide them;
- messages and communications sent through email, telephone, WhatsApp, social media, Wix or Everfit;
- purchase, subscription and transaction information;
- website activity, device information, browser information, approximate location and advertising interactions; and
- any other information you voluntarily provide to us.

We do not directly receive or store your complete payment-card details when payments are processed through third-party payment providers.

3. How we collect information

We may collect information:
- directly from you when you contact us, complete a form, purchase a service, book a session or participate in coaching;
- through Wix, Everfit, WhatsApp, email, telephone and social-media services;
- automatically when you use our website or interact with our advertising;
- from a parent or guardian where services involve a young person; and
- from another person where you have authorised them to provide information or where collection is otherwise permitted by law.

Where practical, we will collect personal information directly from you.

4. How we use information

We may use personal information to:
- respond to enquiries and communicate with you;
- assess whether a service is suitable and safe for you;
- provide Personal Training, online coaching and app-based training;
- create and adjust training programmes;
- monitor progress and provide coaching support;
- manage bookings, purchases, subscriptions and accounts;
- process payments and maintain business records;
- provide customer service and resolve concerns;
- operate, protect, analyse and improve our website and services;
- understand which marketing and website content is effective;
- send marketing communications where you have agreed to receive them or where otherwise permitted by law;
- meet legal, health and safety, accounting and regulatory obligations; and
- protect our legitimate business interests and the safety and rights of clients and others.

We will only use personal information for the purpose for which it was collected, a directly related purpose, with your authorisation or where otherwise permitted by law.

    5. Health and sensitive information

    Training services may require information about injuries, health conditions, medications, limitations and exercise readiness.

    We collect this information so we can assess suitability, support safer training and make appropriate programme adjustments. Providing incomplete or inaccurate information may affect our ability to provide services safely.

    We handle health information in accordance with the New Zealand Privacy Act 2020 and, where applicable, the Health Information Privacy Code 2020.

    Building Better Bodies does not provide medical diagnosis or treatment. We may recommend that you obtain medical clearance or advice from an appropriate health professional before beginning or continuing training.

    We will not disclose health information to another person or health professional unless you authorise us to do so or disclosure is otherwise permitted or required by law.

6. Service providers and disclosure

We may use trusted third-party providers to operate our business and deliver services. These may include:
- Wix for website hosting, forms and website services;
- Everfit for training programmes, coaching, check-ins, bookings and app access;
- payment processors used by Wix or Everfit, including Stripe where applicable;
- WhatsApp and Meta services for communication and advertising;
- Google services for analytics, advertising and business tools;
- email, file-storage, accounting and administrative providers; and
- professional advisers or authorities where reasonably necessary.

These providers may process information only as required to supply their services, comply with their legal obligations or protect their systems and rights.

We may also disclose information:
- with your authorisation;
- where required or permitted by law;
- to respond to an emergency or protect somebody’s health or safety;
- to enforce an agreement or protect our legal rights; or
- as part of a proposed sale or transfer of the business.

We do not sell personal information.

7. Overseas processing

Some providers we use may store or process information outside New Zealand.

Where information is disclosed overseas, we will take reasonable steps to ensure it is protected by appropriate privacy safeguards or rely on another basis permitted under New Zealand privacy law.

Overseas providers may also be subject to the laws of the countries in which they operate.

8. Cookies, analytics and advertising

Our website and service providers may use cookies, pixels and similar technologies.

These technologies may be used to:
- enable essential website functionality;
- remember preferences;
- understand how visitors use the website;
- measure website and advertising performance;
- identify errors and improve user experience;
- measure enquiries or purchases resulting from advertising; and
- deliver or improve relevant advertising.

We may use services including Wix Analytics, Google Analytics, Google advertising or conversion tools and the Meta Pixel.

These providers may collect information such as pages viewed, actions taken, device and browser details, approximate location, referral source and advertising identifiers. Google and Meta may combine this information with information held through their own services, in accordance with their respective privacy policies.

Where required, non-essential analytics or advertising technologies will be managed through website consent settings. You can also control cookies using your browser settings and manage advertising preferences through Google and Meta.

Blocking some cookies may affect how parts of the website operate.

9. Security

We take reasonable steps to protect personal information against loss, unauthorised access, misuse, alteration or disclosure.

These steps include using reputable service providers, password-protected accounts, access controls and appropriate care when handling sensitive information. No internet or electronic-storage system can be guaranteed to be completely secure.

If a privacy breach occurs, we will assess it and notify affected people and the New Zealand Office of the Privacy Commissioner where required by law.

10. Retention

We retain personal information only for as long as it is reasonably required to provide services, maintain necessary business records, resolve disputes and meet legal, tax or regulatory obligations.

When information is no longer required, we will take reasonable steps to securely delete it or remove identifying details. Information may remain in secure backups until those backups are routinely replaced.

11. Young people

Building Better Bodies provides services that may include youth athletes.

We take additional care when collecting and using information about children and young people. Depending on the young person’s age, maturity and circumstances, we may involve or obtain authorisation from a parent or guardian.

Information about a young person will only be collected and used where reasonably necessary to assess suitability, provide safe coaching, communicate appropriately and manage the service.

12. Accessing or correcting your information

You may ask whether Building Better Bodies holds personal information about you and request access to that information.

You may also ask for information to be corrected if you believe it is inaccurate or incomplete. We may need to verify your identity before actioning a request. Any refusal or limitation will only be made where permitted by law.

You may also ask us to delete information. We will honour the request where reasonably possible, subject to information we must retain for legal, safety, financial or legitimate business purposes.

13. Marketing communications

We will only send electronic marketing where you have agreed to receive it or where it is otherwise permitted by law.

You can ask us to stop sending marketing communications at any time by using an unsubscribe option or contacting us.

Service-related communications concerning your programme, sessions, account, subscription or purchase are not marketing messages.
